Apply for a Study Permit

The study permit grants a person legal authorization to study at a Designated Learning Institution (DLI) in Canada. When applying for a study permit, a foreign national should be aware of the eligibility requirements which must be met when submitting the study permit application.

There are many steps involved with applying for a study permit and the processing times vary from country to country. It is best to plan ahead to ensure your permit will be processed before your study period begins. Generally, the majority of Canadian post-secondary educational programs commence study in September, January, or May.

A foreign national cannot apply for a study permit without an acceptance letter, they should check the start date and application process for their schools and programs of interest far in advance to ensure they have enough time to obtain the acceptance letter and complete the study permit application.

Application Deadlines:

Canadian schools impose different application deadlines for international students compared to students applying from inside Canada. Make sure that you know the deadline for your program!

Study Permit Requirements

There are two sets of requirements you must consider when applying for a Canadian study permit: eligibility requirements, and requirements while studying in Canada.

Eligibility Requirements

You must meet these criteria in order to be eligible to apply for a study permit:

  • Acceptance Letter: You must have an Letter of Acceptance from a Designated Learning Institution (DLI) in order to apply for a Canadian study permit.
  • Proof of Financial Support: You must provide documentation proving that you have sufficient funds to cover the cost of tuition for your first year of study as well as the cost of living for yourself and any accompanying family members for your first year of study. Please note that these funds can be under your name or the name of a family member.
  • Supporting Documentation: Extensive supporting documentation must be submitted with all study permit applications. This documentation varies from country-to-country. In order to determine the documents required for a specific location, you can visit IRCC website or you can contact our firm and one of our Immigration consultants will assist you.

When you apply for your permit, the visa officer will make sure you meet the requirements. If the visa officer is not satisfied, they will refuse your application.

Application Process

There are four stages to obtaining a Canadian study permit:

  1. Check your eligibility Ensure you meet the eligibility requirements for a Canadian study permit. You require an Letter of Acceptance from a DLI, proof of financial support, as well as a range of documents which vary depending on your countries of citizenship and residence.
  2. Prepare your application If you meet all eligibility requirements then you can prepare your study permit application. Ensure that you have gathered all documents required for your country. Immigration officers reserve the right to refuse study permits if they feel an applicant has not met all requirements, so it is valuable to have a licensed and experienced Immigration Consultant review your application prior to submission.
  3. Submit your study permit application There are two options to submit your application: Submit an electronic application: Create an account on the Immigration, Refugees and Citizenship Canada (IRCC) website and you can submit an application electronically using scanned or electronic copies of documents. Submit a paper-based application: Compile your application in hard copy and mail it to the Visa Application Centre (VAC) assigned to your country.
  4. If your study permit is approved, you will receive a message to submit your passport for stamping. You will receive your study permit when you arrive at a Canadian Port of Entry (POE). Please note that your study permit is not a visa. This means that, depending on your country of citizenship, you may need a travel visa in order to come to the POE in Canada.

If you are a Canadian citizen or permanent resident, here is an overview on how you can sponsor your spouse, common law partner or conjugal partner for Canadian immigration.

Canada’s spousal sponsorship process explained-

The first stage is to make sure that you and your partner both meet eligibility criteria. You will have to establish that both of you were and are in an ongoing genuine relationship and you are not in a relationship for the convenience of getting Canadian permanent residency.

Canadian Citizen cans sponsor spouse or common law partner even if they are outside Canada. Canadian citizens can apply to sponsor from abroad as long as they demonstrate to IRCC that they will live in Canada once the application is approved. Permanent residents can only sponsor their spouses while staying in Canada, even if their partner is living abroad.

Eligibility criteria for your Canadian partner

Canadian citizens and permanent residents may be eligible to sponsor if they:

  • are at least 18 years old;
  • are a Canadian citizen or permanent resident, or they are an Indigenous person registered under the Canadian Indian Act;
  • demonstrate they are not receiving social assistance unless they have a disability; and
  • can provide for the financial needs of the sponsored person.
  • If married, the marriage should be legal in the country where it occurred as well as in Canada.

Eligibility criteria for you as the person being sponsored

One of these three relationship categories must describe your relationship with your Canadian partner:

  • Spouses: You and your Canadian citizen or permanent resident partner were legally married at an in-person ceremony.
  • Common-law partners: If you are not legally married to your Canadian partner, you must have been living together for at least 12 consecutive months.
  • Conjugal partner: If you are not legally married to your Canadian partner, but have been in a marriage like relationship for at least one year, reside outside of Canada, and are unable to marry them due to circumstances beyond your control , IRCC may consider the relationship as a conjugal partnership. Some of the reasons preventing marriage may include cultural, religious, or legal reasons.

You must be at least 18 years old to be sponsored under any of these categories.

Inadmissibility- You must also pass health, security, and criminality screening to ensure that you are not inadmissible to Canada.

How to apply for spousal sponsorship

Once you establish that you and your partner are eligible for sponsorship, you can then get application package on the government web page. Then you have to pay the necessary fees on IRCC’s website, which include a processing fee, a right of permanent residence fee, and a biometrics fee. You may be exempted from doing biometrics if you have done it in the past 10 year. You have to submit two applications together at the same time: a sponsorship application and a permanent residence application.

Undertaking

Once your application is approved, you and your partner still have to uphold some of the conditions of spousal sponsorship. Your Canadian partner is financially responsible for you for three years. If you ask the government for financial assistance in that time, your partner may be forced to repay the government.

You as the sponsored person may not sponsor another partner for five years after having been sponsored.
